Abstract
The costs which are incurred in undertaking court or arbitration proceedings are an important consideration when determining the method which should be employed in resolving disputes which arise in the construction industry.
This article, prepared by Kevin Owen, a partner of the firm of Baker & McKenzie, solicitors, discusses the bases on which both the courts and arbitrators award costs to the parites involved in such proceedings, and the rules applicable to making payments into court which may be utilised to protect a Defendant's exposure to legal costs.
