Abstract
In the first of a two-part series, Tim Steadman, a Partner with Baker & McKenzie, explores some of the legal mechanisms by which the risk of geotechnical failure is allocated (whether knowingly or otherwise) and highlights some recent developments regarding those mechanisms.
The term "geotechnical failure" is taken to embrace not only physical catastrophe, but also any failure to realise commercial objectives which is caused by geotechnical factors.
This first article looks at this issue in relation to the employer and the contractor.
