Abstract
Tendering for construction contracts has become vicious as contractors begin to compete internationally. Offering bids low enough to bankrupt most other contractors successful tenderers have now taken to the courts as a means to recoup losses and even make profits. David Shoesmith explores this 'claims' trend and provides some possible alternatives in this two part series. This month, the phenomenon is discussed together with the introduction of alternatives at the precontract stage. Next month, more alternatives will be presented.
