Abstract
Recent years have seen significant departures from the traditional contract structure previously in dominant usage in the construction industry. By the "traditional" structure is meant that of an architect designing the works on behalf of the developer, the developer entering into a direct contract with a construction company and the architect acting as the contract administrator.
The most significant alternative developments have been design-and-build (or turnkey) contracts, management contracting and project management. This article, prepared by Damien J Hughes, a Partner with the firm of Baker & McKenzie, Solicitors, will focus primarily on management contracting.
