Abstract
The traditional contractual arrangement places great importance on contracts between client and main contractor, with architects, quantity surveyors and other professional advisers participating directly in the contract as agents of the client. Specialist firms are not parties to the contract and indeed, are somewhat remote from it. Often, these specialists operate as sub-contractors and are generally only in contract with the main contractor. In this first of two parts, Construction Commercial Services Ltd managing director Michael Salmon examines the significant features of this arrangement, in particular the undue degree of contractual remoteness of the specialists from the client. (1) Contractual relationships 合約關係 (2) Countering abuses 防止濫用合約安排 (3) Standard sub-contract forms 標準的分包承建合約 (4) Non-standard forms 非標準合約 (5) Pay-when-paid 收款後付款 (6) Specious and irrelevant (7) Set-off 債務抵消 (8) Other contractual abuses 其他濫用合約行為
