Abstract
Most forms of construction contract contain variation clauses which permit the contract administrator to vary the works. In addition to ordering of additional work, such provisions normally allow work to be omitted. Contractors often ask whether they are entitled to loss of the profit which they would have earned on work which has been omitted under the variation clause. As always, the answer depends. (1) Loss of profit-damages for breach (2) Loss of profit under the contract
