Abstract
This is the second part of a two-part article that surveys the reaction of courts throughout the common law world to the use of formulae to calculate indirect looses caused by delay. In this part, Geoffrey Shaw and Glenn Haley report on the reception which the Eichleay formula has received, as well as on two specific problems linked to the use of formulae. They conclude by offering guidelines for using formulae effectively.
